We represent clients before Swedish courts, the Unified Patent Court (UPC), and various registration offices.

The business aspect of handling cases

Bergenstråhle’s lawyers are committed to identifying the best solution from the client’s business perspective. Sometimes, taking legal action by filing a lawsuit is the most appropriate way to resolve the case. However, the majority of cases end in cost effective settlements, either before or after a lawsuit has been filed.

Bergenstråhle will support the client in negotiations and setting up an agreement therein securing the best possible settlement for the client.

Administrative actions

Basic services are administrative actions appealing decisions by the registration offices, PRV, EPO and EUIPO included, and filing or defending on actions of oppositions or for revocations or invalidity.

Commercial Law

Bergenstråhle also provides advice and represents clients in litigation cases regarding commercial and contract law. Our team of commercial lawyers has vast experience of working directly with contract drafting. Together with the team of litigation attorneys, this expertise enables us to navigate disputes effectively and advocate for our clients, ensuring they achieve the best possible business outcomes in their legal matters.

Basic services are court actions regarding infringement, invalidity/revocation, better rights, unlawful actions, misleading or unfair practices, in all intellectual property matters, as well as issues in contract law and other business-related matters. Actions can result in injunctions, preliminary injunctions, damages and destruction of infringing products etc.

UPC

The Unified Patent Court (UPC) handles all patent cases based on European patents (EP) not specifically excluded by an opt-out. Since the UPC’s start of operations in June 2023, Bergenstråhle has had an experienced team of attorneys entitled to represent parties before the UPC, including two attorneys at law and one European Patent Attorney, qualified with a European Patent Litigation Certificate.

International coordination

With an extensive international network, and no ties to specific local firms, Bergenstråhle assists in cases that require resolution in other countries, helping you to find the appropriate local representative for the client´s specific needs. And, perhaps most importantly, we coordinate these international efforts to simplify the decision-making process for the client.
